Ordering Terms
These terms apply when you order online from:
1. Who you are buying from
Your order is placed with the restaurant named above, and your agreement to buy the food is with them. They prepare it, they take the payment, and they are responsible for it.
The restaurant uses an ordering service provider for its online ordering. That provider supplies the technology only: it is not the seller, does not prepare food, and is not a party to your purchase.
2. Placing an order
Choosing items and pressing Place Order is an offer to buy, not a completed sale. Your order is only confirmed once the restaurant accepts it, which they do on their own device. A restaurant can decline an order, for example when they are unexpectedly closed, out of an item, or cannot deliver to your address.
You must be old enough to enter into a contract where you live, and the contact details you give must be your own and correct. The restaurant may need to reach you about your order.
3. Prices, taxes, fees and tips
The restaurant sets its prices, and may add tax, delivery charges and service fees. Everything that will be charged is itemised before you pay. All prices are in US dollars.
Any tip you add goes to the restaurant or, on a delivery, is passed on as part of the delivery. Tipping is optional and you can set it to zero.
4. Paying
Card payments are handled by Stripe on the restaurant’s own Stripe account. Neither the restaurant nor its ordering service provider ever sees your full card number.
Placing the order authorises your card for the total and puts a hold on that amount. The money is only taken when the restaurant accepts the order. If they decline it, or it expires without being accepted, the hold is released. How long a released hold takes to disappear from your statement is up to your bank, not the restaurant.
5. Pickup and delivery
Any time shown for pickup or delivery is the restaurant’s estimate, not a guarantee. Kitchens get busy and traffic happens.
Where the restaurant offers delivery, it may be carried out by a courier arranged through Uber Direct rather than by the restaurant itself. To make that happen the restaurant shares your name, phone number, delivery address and order details with Uber, and the courier may call or message you. Uber’s own terms and privacy notice apply to the courier’s handling of the delivery.
Give a delivery address someone can actually reach, with any building or apartment detail the courier needs. If nobody is there and you cannot be reached, the restaurant is not obliged to refund the order.
6. If something is wrong with your order
Contact the restaurant. Their phone number and email are at the top of this page. They decide whether to remake an order, refund it in whole or in part, or offer something else, and they issue any refund from their own account.
The ordering service provider cannot refund you, cancel your order or change what the restaurant decides. If you paid by card and believe a charge is wrong, you also have whatever rights your card issuer gives you.
7. Allergies and food safety
If you have a food allergy or intolerance, contact the restaurant before ordering. Menu descriptions and any allergen or dietary labels come from the restaurant, kitchens handle many ingredients in the same space, and recipes change. Neither the restaurant nor its ordering service provider can promise a dish is free of any particular ingredient through this ordering page alone.
The restaurant is responsible for the food it prepares and for meeting the food safety rules that apply to it.
8. What is on the menu
Menu items, descriptions, photographs and prices are supplied and kept up to date by the restaurant. Photographs are illustrative. If a listing is wrong, the restaurant may decline the order rather than honour a mistaken price.
9. Using the ordering page
Use it to place genuine orders. Do not attempt to interfere with it, place fraudulent orders, or use it in a way that disrupts the restaurant or other customers.
10. Your information
What is collected when you order, who it is shared with, and how to ask for a copy or have it deleted are set out in the privacy notice for this restaurant, linked from the same place you found this page.
11. Changes
These terms may be updated. The terms that apply to an order are the ones published at the time you placed it.
12. Governing law
This agreement is governed by the laws of Florida, where the restaurant is located, without regard to its conflict-of-laws rules.
